Terms of Service

You must be at least 18 years of age to create an account, subscribe to creators, upload content, or use any feature of Twinkle Toes. By registering, you represent and warrant that:

• You are 18 years of age or older.
• You have the legal capacity to enter into a binding contract.
• You are not prohibited from using the platform under applicable laws.
• All information you provide during registration is accurate and truthful.

Twinkle Toes complies with 18 U.S.C. § 2257 record-keeping requirements. All content creators must verify their age and identity before publishing any adult content. We reserve the right to request proof of age at any time and to suspend accounts where eligibility cannot be confirmed.

To use certain features of the platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain and update your information to keep it accurate.
• Keep your password confidential and not share it with third parties.
• Notify us immediately at support@twinkletoes.com of any unauthorized use of your account.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain false information or that we reasonably suspect have been compromised.

If you upload or publish content as a Creator, you represent and warrant that:

• You are the sole owner of all content you upload, or have all necessary rights and licenses to upload it.
• All individuals depicted in your content are at least 18 years old and have provided explicit, documented consent.
• Your content does not infringe any third-party intellectual property, privacy, or publicity rights.
• Your content does not contain illegal material, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content promoting violence.
• You will maintain age verification records for all persons depicted in adult content, as required by 18 U.S.C. § 2257 and similar applicable laws.
• You will not upload content involving minors in any sexual or suggestive context. Any such upload will result in immediate account termination and reporting to law enforcement.

The following content and conduct are strictly prohibited on Twinkle Toes:

• Any content depicting or suggesting minors in a sexual context.
• Non-consensual intimate imagery ("revenge porn").
• Content that harasses, threatens, or incites violence against any individual or group.
• Content that promotes or glorifies illegal activities.
• Spam, phishing, or fraudulent activity.
• Impersonation of any person or entity.
• Distributing malware or engaging in unauthorized data collection.
• Attempting to circumvent age verification or content access controls.
• Chargebacks or payment fraud.

Violation of these prohibitions may result in immediate account termination and, where applicable, reporting to law enforcement authorities.

Subscriptions: Fans may purchase monthly subscriptions to access a creator's gated content. Subscription fees are charged at the beginning of each billing cycle and renew automatically unless cancelled.

Tips: Users may send voluntary tips to creators. Tips are non-refundable once processed.

Cancellations: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to subscribed content until then.

Refund Policy: All purchases are final. Refunds are issued solely at our discretion in cases of documented technical failure or fraudulent charges. To request a refund, contact support@twinkletoes.com within 7 days of the charge.

Platform Fee: Twinkle Toes retains 20% of all creator earnings. Creators receive 80% of subscription and tip revenue, subject to applicable taxes and payout minimums.

Taxes: You are responsible for reporting and paying all applicable taxes on income earned through the platform. We may issue tax forms (e.g. 1099-NEC) where required by law.

Creator payouts are subject to:

• Completion of identity verification (KYC) as required by financial regulations.
• Linking a valid bank account.
• A minimum payout balance as specified in the Earnings dashboard.
• A processing period of up to 7 business days.

We reserve the right to withhold payouts if we have a reasonable belief that the associated account has engaged in fraud, chargebacks, or policy violations pending investigation.

Creators retain ownership of their original content. By uploading content to Twinkle Toes, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purposes of operating the platform.

The Twinkle Toes name, logo, and platform design are our exclusive property. You may not use our trademarks without prior written consent.

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to our privacy practices.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWINKLE TOES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE TOTAL AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Twinkle Toes and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the platform; (b) your content; (c) your breach of these Terms; or (d) your violation of any applicable law or third-party rights.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the platform shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality matters.

Class Action Waiver: You waive your right to participate in any class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the platform after such changes constitutes your acceptance of the new Terms.

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the platform ceases immediately. Sections relating to intellectual property, disclaimers, indemnification, and dispute resolution survive termination.
